How we ranked them

We started from the agencies that rank in Google for “estate planning marketing agency” and related searches, then kept firms with a dedicated estate planning practice, named estate planning case studies, or the closest specialist fit. Each was scored on five things: depth of specialization in estate planning attorneys, verifiable proof (named clients, third-party reviews), transparency on pricing and terms, client-friendly terms (contract length, who owns the website, ad accounts and tracking numbers), and fit for small and mid-sized firms. Lead marketplaces and pure software tools were excluded because they are not agencies.

The 10 best marketing agencies for estate planning attorneys

The 2026 sunset that never came: outdated urgency copy is the attorney's ethics problem

For years, estate planning seminar invitations and ads leaned on one deadline: the federal exemption would be cut roughly in half on January 1, 2026. That did not happen. The One Big Beautiful Bill Act set the basic exclusion at $15 million for 2026 with no automatic sunset and indexing for inflation after 2026, and the IRS confirmed in IR-2025-103 that estates of decedents dying in 2026 have a $15,000,000 basic exclusion amount. A mailer, webinar title or landing page still warning that the exemption is about to drop now states the law incorrectly.

ABA Model Rule 7.1 (New Hampshire's adopted version uses the same words) bars a lawyer's communication that contains a material misrepresentation of fact or law, and Comment [5] to Model Rule 7.2 requires a paid lead generator's communications to be consistent with Rule 7.1. The agency writes the copy, but the attorney named on it carries the bar risk. Before signing, ask to see the invitations, ads and email sequences an agency is running for other estate planning firms today. None of the nine agencies below featured sunset urgency on the pages we reviewed in October 2026, but reused templates deserve a line-by-line check.

Questions to ask any estate planning marketing agency before you sign

  1. Can I see the live ad copy, seminar invitations and email sequences you are running for other estate planning firms right now? Under Model Rule 7.1 the attorney answers for misleading statements of law in their ads. Recycled pre-2025 'exemption sunset' templates are the most common way estate planning copy goes stale.
  2. How exactly are you paid: flat retainer, per lead, per seminar registrant, or a share of my fees? Model Rule 5.4(a) bars sharing legal fees with a nonlawyer, and Comment [5] to Rule 7.2 requires lead-generator payments to be consistent with Rules 5.4 and 1.5(e). Any pay-per-signed-plan or percentage-of-fee model should be cleared with your state bar's ethics guidance first.
  3. Do any of your ads, landing pages or call scripts say or imply that you recommend me? Comment [5] to Model Rule 7.2 says a lawyer must not pay a lead generator that states, implies or creates a reasonable impression that it is recommending the lawyer.
  4. If we part ways, who owns the website, domain, Google and Meta ad accounts, call-tracking numbers and the seminar or webinar registrant list? Estate planning prospects often take months to sign, so the registrant and nurture list is the asset. Few agencies in this niche put ownership terms in writing on their sites; get it in the contract.
  5. What exactly is guaranteed: registrations, attendance, or signed clients? Seminar programs in this niche typically guarantee RSVPs or registrants, not engagements. LeadingResponse's FAQ, for example, states it does not guarantee ROI from a seminar.
  6. Is my territory exclusive, how is it defined, and do I lose it if I pause? Seminar-system vendors such as K Dunn & Associates sell one practice per market. Know the map and the pause rules before you build your calendar around it.
  7. Who reviews trust, probate and tax content for legal accuracy, and against which year's law? Federal exemption figures changed for 2026 and state estate and inheritance tax thresholds differ, so content written by non-lawyers needs attorney sign-off before it is published under your name.
  8. What is the minimum term, notice period and renewal mechanism? Most agencies on this list do not publish contract terms, and at least one client testimonial on an agency homepage references a three-year renewal. Ask for the agreement before the sales call ends.

Agency or fractional CMO?

An agency executes channels: it runs your ads, writes your content or builds your SEO. A fractional CMO owns the plan: it decides which channels deserve budget, sets the targets, and manages whoever executes, including agencies. Many estate planning attorneys need both, with the strategist hired first so the agency is measured on signed clients rather than clicks. Read more on fractional CMO services for estate planning attorneys and how to choose the right marketing help.
